Terms and Conditions of Use Agreement
You Must Read and Agree to This Terms of and conditions of Use Agreement Before Accessing or using the Money Style® Website.
This Terms of Use Agreement ("Agreement") governs your use of the Money Style website at www.moneystyle.net (the "Website"), brought to you by Consumer Credit Counseling Service of the Midwest, Inc. ("Money Style"). The Website is designed to provide you with financial information and education resources. By using the Website, you (the "User" or "you") agree to these terms and conditions. If you do not agree to the terms and conditions of this Agreement, you must immediately cease all usage of the Website.
MODIFICATIONS TO THIS AGREEMENT. Money Style reserves the right, at any time, to modify, alter, or update the terms and conditions of this Agreement without prior notice to you. Modifications shall become effective immediately upon being posted at the Website. Your continued use of the Website after modifications are posted constitutes an acknowledgement and acceptance of this Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be otherwise amended.
1. Description of Service and Accessing the Website
Money Style is providing User, via the Website, with online financial information and education resources (sometimes called the "Service"). The Service is only available for Users who are sponsored by their employer, financial institution, financial counseling service or other organization (a "Sponsor"). If a Sponsor cancels its sponsorship with Money Style, or does not timely pay its sponsorship fees, your use of the Service may be immediately terminated and any of your stored information may be lost or discarded. The Sponsor must provide you with a unique User code in order to use the Website. This code is personal to you and you may not share it with any other person or User. Similarly, after you set up a unique username and password to access the Website, you may not share them with any other person or User. In order to use the Website, each User must provide (1) all equipment necessary for User’s own Internet connection, including computer and modem, (2) User’s own access to the Internet and browser software, and (3) any fees related with such Internet connection and software.
2. Use of and Restrictions Regarding the Website
You may only use the Website for your own personal use. Only Users who are at least 18 years of age may use the Website. User may not alter, delete, add to or otherwise change any of the content found on the Website. You may print Website pages from your browser, but such printed pages are for your own personal use only. You may not further reproduce such printed pages (or print multiple copies) or distribute any reproduced pages, except as permitted in this Agreement.
3. Sharing of Certain Information
Part of the Service includes interactive features, surveys and tests whereby you may be required to submit detailed personal financial information. You may wish, or your Sponsor may require as a condition of your use of the Website, that Money Style share all or portions of your responses and other personal financial information with the Sponsor. In order to share your personal financial information with the Sponsor, you must affirmatively permit Money Style to do so. The applicable portions of the Website will ask for your permission to share personal financial information with a Sponsor, and Money Style will only share such information with a Sponsor if you have provided your consent. Money Style will be able to use and distribute aggregated or de-identified personal and financial information freely in accordance with the terms of the Money Style Privacy Policy.
4. Disclaimer of Warranties
The site is provided by Money Style on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Money Style makes no representations or warranties of any kind, express or implied, regarding the use or the results of the Website in terms of its correctness, accuracy, reliability, or otherwise. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of the Website is at your own discretion and risk and that you will be solely responsible for any RESULTS OR ANY damage to your own computer system or loss of data that results from the download of such material and/or data. Money Style disclaims all warranties with regard to the WEBSITE AND THE information provided THEREON, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions may not allow the exclusion of implied warranties, therefore the above-referenced exclusion may not apply to you.
5. Limitation of Liability
as a condition to your use of the website, you agree that Money Style SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, AND IN PARTICULAR MONEY STYLE SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOSS OF REVENUE, OR LOSS OF USE, ARISING OUT OF OR RELATED TO THE WEBSITE, THE INFORMATION CONTAINED ON THE WEBSITE, ANY INFORMATION OR SITES LINKED TO BY THE WEBSITE, OR YOUR USE OF SUCH INFORMATION, WHETHER SUCH DAMAGES ARISE IN CONTRACT, NEGLIGENCE, TORT, UNDER STATUTE, IN EQUITY, AT LAW, OR OTHERWISE, EVEN IF MONEY STYLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR ALL OR CERTAIN DAMAGES, THEREFORE SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
6. Indemnification
User agrees to indemnify, defend and hold Money Style, its affiliates, members, officers and employees, harmless from any claim, demand, action, liabilities, loss, damage and expense including, without limitation, settlement costs and reasonable attorneys’ fees, made by or on behalf of any third party due to or arising out of User’s use of the Website or User’s violation of this Agreement.
7. Modifications and Interruption to Service
Money Style reserves the right to modify or discontinue the Service with or without notice to the User. Money Style shall not be liable to User or any third party should Money Style exercise its right to modify or discontinue the Service. User acknowledges and accepts that Money Style does not guarantee continuous, uninterrupted or secure access to the Website and operation of the Website may be interfered with or adversely affected by numerous factors or circumstances outside of Money Style’s control.
8. Third-Party Sites
The Website may include links to other sites on the Internet that are owned and operated by online service providers and other third parties. Those links are provided to you for your reference and convenience only, and you acknowledge that Money Style is not responsible for the availability of, or the content located on or through, any third-party site. Your use of those third-party sites and the information thereon is at your own risk. You should contact the site administrator or webmaster for those third-party sites if you have any concerns regarding such links or the content located on such sites. Your use of those third-party sites is subject to any terms of use and privacy policies of each site, which you should review before using such sites, and Money Style is not responsible for such sites or policies.
9. Disclaimer Regarding Accuracy of Website Information
The information on the Website has been provided to Money Style or obtained by Money Style employees. Some of the information on the Website may be outdated or inaccurate. While Money Style attempts to ensure that the information on the Website is timely and accurate, Money Style can make no representations or warranties as to the accuracy, timeliness or reliability of any information provided on the Website.
10. Governing Jurisdiction of the Courts of Ohio
The Website is operated and maintained in the State of Ohio. As such, Money Style is subject to the laws of the State Ohio, and User agrees that the laws of Ohio shall govern this Agreement and any other issue arising between the User and Money Style, without regard to any conflict of laws provisions. User agrees to submit to the personal and exclusive jurisdiction of the state or federal courts located in Franklin County, Ohio, for any dispute arising between User and Money Style. User hereby waives any claim or defense based on improper jurisdiction or venue.
11. Compliance with Laws
User shall use the Website only for lawful purposes and is responsible for compliance with any applicable laws. User may not use the Website or the Service in any way that violates applicable law, regulation or other government requirement. User further agrees not to transmit any material that constitutes or encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, or international law or regulation. User agrees that User shall be responsible for any damages caused by User’s improper or unauthorized use of the Website.
12. Copyright and Trademark Information
All content included or available on the Website, including site design, text, graphics, interfaces, and the selection and arrangements thereof is ©2004 - 2007 Consumer Credit Counseling Service of the Midwest, Inc., with all rights reserved, or is otherwise the property of Money Style and/or third parties and protected by intellectual property rights. Any unauthorized use of materials on the Website without the prior written permission of Money Style is strictly prohibited. All other trademarks displayed on the Website are the trademarks of their respective owners, and constitute neither an endorsement nor a recommendation of those owners.
13. Other Terms
If any provision of this Agreement shall be found to be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. You agree that this Agreement and any other policies and agreements referenced herein may be assigned by Money Style, in its sole discretion, to a third party in the event of a merger, acquisition or sale of the assets of Money Style. This Agreement supersedes all other agreements, discussions and communications regarding your use of the Website. User agrees that by accepting this Agreement, User is consenting to the policies and other practices regarding personal and financial information described in Money Style’s Privacy Policy.
